    WEB SITE USER AGREEMENT

    CONVENIENCE FEE

    Your agency has partnered with a third party service provider to provide you with convenient online payment services via credit card debit card or electronic check payments. IN ORDER TO USE THIS SERVICE YOU MAY HAVE TO PAY A NON-REFUNDABLE CONVENIENCE FEE IN ADDITION TO THE AMOUNT(S) OWED TO YOUR PAYEE. Please note that the service provider (not your Payee) will appear as the merchant of record next to your payment on your bank or credit card statement.

    ACCESSIBILITY

    This service is accessible through the Internet. In order to use this service you will need a personal computer access to the Internet with an Internet service provider and a web browser which supports this service.

    ACCURACY OF YOUR INFORMATION AND BILLING; COMPLETION OF PAYMENT

    You are solely responsible for providing accurate and complete information to use this service and for confirming any amount(s) owed to your Payee. Completion of your online payment is contingent upon both (1) the authorization of payment by your credit card company (or financial institution with respect to debit cards and electronic check payments) and (2) acceptance of your payment [and if applicable your tax return] filing by your Payee. If the service provider is unable to process your payment the service provider will attempt to notify you at least once using the contact information you have provided. If your payment is not processed or authorized by your credit card company or financial institution (as applicable) or your payment is not accepted by your Payee your payment liability shall remain outstanding and unpaid and you will be responsible for any penalties late fees and interest charges assessed by your Payee.

    DISCLAIMER; LIMITATION OF LIABILITY

    YOUR USE OF THE SERVICE IS AT YOUR OWN RISK. THIS SERVICE IS PROVIDED AS-IS AND AS AVAILABLE WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES. The service provider shall not be liable for any direct indirect incidental special punitive or consequential damages that result in any way from your use of or inability to use this service or that result from mistakes omissions interruptions deletion of files errors defects delays in operation or transmission or any failure of performance.

    ACCEPTANCE

    By clicking the ACCEPT TERMS button you agree to these terms and to pay the non-refundable convenience fee (IF APPLICABLE) charged by the service provider for this service.

    SINGLE ECHECK/ACH TRANSACTION

    I authorize Point and Pay, LLC to debit the bank account indicated in this web form for the noted amount on today’s date. I understand that because this is an electronic transaction, these funds may be withdrawn from my account as soon as the above noted transaction date. In the case of an ACH Transaction being rejected for Non Sufficient Funds (NSF) I understand that the business may at its discretion attempt to process the charge again within 30 days, and agree to an additional $25 charge for each attempt returned NSF which will be initiated as a separate transaction from the authorized payment. I acknowledge that the origination of ACH transactions to my account must comply with the provisions of U.S. law. I will not dispute Point and Pay, LLC debiting my checking/savings account, so long as the transaction corresponds to the terms indicated in this web form.

    SCHEDULED/RECURRING ECHECK/ACH TRANSACTION

    I authorize Point and Pay, LLC to debit the bank account indicated in this web form for the noted amount on the schedule indicated. I understand that this authorization will remain in effect until the schedule end date, or until I cancel it in writing, which ever comes first, and I agree to notify the business in writing of any changes in my account information or termination of this authorization at least 15 days prior to the next billing date. If the above noted payment date falls on a weekend or holiday, I understand that the payment may be executed on the next business day. I understand that because this is an electronic transaction, these funds may be withdrawn from my account each period as soon as the above noted transaction date. In the case of an ACH Transaction being rejected for Non Sufficient Funds (NSF) I understand that the business may at its discretion attempt to process the charge again within 30 days, and agree to an additional $25 charge for each attempt returned NSF which will be initiated as a separate transaction from the authorized recurring payment.     • Provide, troubleshoot, and improve Point & Pay Services. We use your personal information to provide functionality, analyze performance, fix errors, and improve the usability and effectiveness of the Point & Pay Services.
    • Comply with legal obligations. In certain cases, we collect and use your personal information to comply with laws. For instance, response to government or law enforcement related inquiries.
    • Communicate with you. We use your personal information to communicate with you in relation to Point & Pay Services via different channels (e.g., by phone, email, chat).
    • Fraud Prevention and Credit Risks. We use personal information to prevent and detect fraud and abuse in order to protect the security of our customers, Point & Pay, and others.

    Children under 13. Point & Pay complies with the requirements of the Children’s Online Privacy Protection Act (COPPA) and the FTC’s Rule interpreting COPPA (16 CFR § 312). The Web Sites are not directed to children of any age and Point & Pay does not knowingly collect in any manner any Personal Information from children under 13 years of age.

    Business Transition. In the event Point & Pay goes through a business transition, such as a merger, acquisition by another company or a sale of a portion of Point & Pay’s assets, your Personal Information may be part of the assets transferred.
